Cancellation and Refund Terms

CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION – RETURN CONDITIONS

 

GENERAL:

1. If you place an order electronically through the website you are using, you are deemed to have accepted the preliminary information form and the distance sales agreement presented to you.

2. Buyers are subject to the provisions of Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation (Official Gazette: 27.11.2014/29188), as well as other applicable laws, regarding the sale and delivery of the purchased product.

3. Shipping costs for product delivery shall be paid by the buyer.

4. Each purchased product shall be delivered to the person and/or organization at the address indicated by the buyer, provided that it does not exceed the legal period of 30 days. If the product is not delivered within this period, buyers may terminate the contract.

5. The purchased product must be delivered complete, in accordance with the specifications stated in the order, and with any required documents such as a warranty certificate and user manual.

6. If it becomes impossible to sell the purchased product, the seller must notify the buyer in writing within 3 days of learning this situation. The total amount must be refunded to the buyer within 14 days.

IF THE PURCHASE PRICE IS NOT PAID:

7. If the buyer does not pay for the purchased product or cancels the payment in bank records, the seller’s obligation to deliver the product ends.

PURCHASES MADE WITH UNAUTHORIZED USE OF A CREDIT CARD:

8. After the product is delivered, if it is determined that the credit card used for payment was unfairly used by unauthorized persons and the product price is not paid to the seller by the relevant bank or financial institution, the buyer must return the product to the seller within 3 days, with shipping costs covered by the seller.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEN REASONS:

9. If force majeure circumstances arise that the seller could not foresee and the product cannot be delivered on time, the buyer will be informed. The buyer may request cancellation of the order, replacement with a similar product, or postponement of delivery until the obstacle is removed. If the buyer cancels the order and paid in cash, the amount will be refunded in cash within 14 days. If payment was made by credit card, the amount will be refunded to the bank within 14 days; however, the bank may take 2–3 weeks to transfer it to the buyer’s account.

BUYER’S OBLIGATION TO CHECK THE PRODUCT:

10. Before accepting the goods/service, the buyer must inspect them and must not accept damaged or defective goods/services such as crushed, broken, or torn packaging from the courier. Accepted goods/services are deemed to be intact and undamaged. The buyer must protect the goods/services carefully after delivery. If the right of withdrawal is to be exercised, the goods/services must not be used. The invoice must also be returned with the product.

RIGHT OF WITHDRAWAL:

11. The buyer may exercise the right of withdrawal within 14 (fourteen) days from the date of delivery of the purchased product to themselves or the person/organization at the address indicated, by notifying the seller via the contact details below, without assuming any legal or criminal liability, if the product is defective or does not have the characteristics specified on www.irismostore.com.

DURATION OF THE RIGHT OF WITHDRAWAL:

13. If the purchased item is a service, this 14-day period starts from the date the contract is signed. The right of withdrawal cannot be exercised for service contracts where performance has begun with the consumer’s approval before the withdrawal period ends.

14. Costs arising from the exercise of the right of withdrawal belong to the seller.

15. To exercise the right of withdrawal, written notification must be sent to the seller by registered mail, fax, or email within 14 days, and the product must be unused in accordance with the provisions regarding products for which the right of withdrawal cannot be exercised.

USE OF THE RIGHT OF WITHDRAWAL:

16. The invoice of the product delivered to a third party or the buyer must be returned. (If the invoice is issued in the name of a company, it must be returned together with a return invoice issued by that company.)

17. The return form, box, packaging, and all standard accessories must be returned complete and undamaged.

RETURN CONDITIONS:

18. The seller is obliged to refund the total amount and return the documents that put the buyer under debt within 10 days from receiving the withdrawal notice and to take back the goods within 20 days.

19. If the value of the goods decreases due to the buyer’s fault or return becomes impossible, the buyer must compensate the seller’s damages in proportion to their fault. However, the buyer is not responsible for changes and deterioration caused by proper use of the product within the withdrawal period.

20. If the campaign limit falls below due to the exercise of the withdrawal right, the discount amount benefited from within the campaign will be canceled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:

21. Products prepared according to the buyer’s request or personal needs, underwear bottoms, swimwear bottoms, cosmetics, disposable products, perishable goods, products unsuitable for return due to health and hygiene if the packaging has been opened, goods mixed with other products after delivery and cannot be separated by nature, periodicals such as newspapers and magazines, instantly performed electronic services, intangible goods delivered instantly, audio/video recordings, books, digital content, software, data storage devices, and computer consumables cannot be returned if their packaging has been opened. The right of withdrawal also cannot be exercised for services started with consumer approval before the withdrawal period ends.

22. For cosmetics, personal care products, underwear, swimwear, books, software, DVDs, VCDs, CDs, cassettes, and stationery consumables (toner, cartridges, ribbons, etc.), the packaging must be unopened, unused, and undamaged for return.

DEFAULT AND LEGAL CONSEQUENCES

23. If the buyer defaults on payments made by credit card, they accept, declare, and undertake to pay interest within the framework of the credit card agreement with the bank and be responsible to the bank. The bank may take legal action and demand costs and attorney fees. In all cases of default due to debt, the buyer accepts to compensate the seller’s losses due to delayed performance.

25. Through our website, you can make single or installment payments with your credit card. For online payments, the amount will be charged to your credit card at the end of your order.
